Pesë nga njëmbëdhjetë anëtarët e Këshillit do të zëvendësohen me anëtarë të rinj. Pothuajse gjysma e tij. Kjo i jep procesit të sotëm një peshë të veçantë institucionale dhe na vendos përpara një përgjegjësie që shkon përtej vetë aktit të votimit.</p><p>Përpara se të votojmë, besoj se është e dobishme të reflektojmë mbi disa pyetje: <i>Çfarë kemi pritur nga Këshilli? Çfarë kemi marrë prej tij? Çfarë nuk ka funksionuar mirë?</i> E mbi të gjitha, <i>çfarë Këshilli na duhet për të ardhmen?</i></p><p>Në këto vite kam folur shpesh për Këshillin e Lartë Gjyqësor. E kam mbështetur kur kam menduar se duhej. E kam vlerësuar për atë që është bërë mirë, por kam qenë edhe kritik kur kam gjykuar se ritmi, vendimmarrja apo rezultatet nuk u përgjigjeshin nevojave të sistemit.&nbsp;</p><p>Unë besoj se institucionet nuk mbrohen duke heshtur për dobësitë e tyre. Ato mbrohen kur kanë, si kurajon t’i njohin dobësitë, ashtu dhe aftësinë për t’i korrigjuar ato.</p><p>KLGJ-ja e ka ushtruar mandatin në një periudhë jashtëzakonisht të vështirë. Pasojat e procesit të rivlerësimit, mungesa e gjyqtarëve dhe riorganizimi i hartës gjyqësore i kanë shtuar vështirësitë e emërimeve, ngritjeve në detyrë, transferimeve dhe vlerësimeve. Në periudha të caktuara, gjykatat janë detyruar të përballojnë ngarkesën me kapacitete shumë më të kufizuara se sa u nevojiteshin. <strong>Përpjekjet e Këshillit për ta mbajtur sistemin në funksionim në këto kushte meritojnë vlerësim. Po aq e nevojshme është të shohim ku vendimmarrja e tij duhet të jetë më e shpejtë dhe më pranë nevojave të gjykatave.</strong></p><p>Tetë vjet pas ngritjes së organeve të qeverisjes së sistemit të drejtësisë, kemi tashmë përvojën e nevojshme që suksesin të mos e masim vetëm me ngritjen e institucioneve, por me mënyrën se si ato funksionojnë dhe me rezultatet që prodhojnë.</p><p>Kushtetuta i ka besuar KLGJ-së përgjegjësinë për mirëfunksionimin dhe qeverisjen e pushtetit gjyqësor. Prandaj çështja nuk është sa akte janë miratuar apo sa procedura janë hapur. Çështja më e rëndësishme është: <i>çfarë ka ndryshuar realisht në aftësinë e gjykatave për t’i dhënë qytetarit drejtësi cilësore dhe në kohë?</i>&nbsp;Këtu fillon bilanci i vërtetë.&nbsp;</p><p>Një gjykatë nuk funksionon vetëm me ligje dhe rregullore. Ajo ka nevojë për gjyqtarë të mjaftueshëm, administratë profesionale, drejtues dhe kancelarë të zgjedhur në kohë, këshilltarë dhe staf mbështetës, teknologji bashkëkohore, siguri, ambiente dinjitoze dhe burime financiare që i përgjigjen funksionit të saj.</p><p>Një gjyqtar e ka të vështirë të ndërtojë karrierën normalisht, kur vlerësimi etiko-profesional vonohet përtej çdo kohe të arsyeshme. Administrimi i një gjykate dobësohet, kur pozicionet drejtuese mbeten për vite të paplotësuara. Shpejtësia dhe cilësia e gjykimit cenohen, kur ngarkesa të mëdha përballohen me më pak gjyqtarë dhe më pak personel nga sa kërkon funksionimi normal i sistemit.&nbsp;</p><p>Një drejtësi e shekullit XXI kërkon teknologji moderne. Dinjiteti i drejtësisë kërkon godina, salla gjykimi dhe kushte pune, që i përgjigjen funksionit që ushtrohet aty. Mbi të gjitha, pavarësia e gjyqësorit kërkon që gjyqtari ta ushtrojë detyrën i lirë nga frika dhe kërcënimi.&nbsp;</p><p>Pas pak ditësh, më 6 tetor, mbushet një vit nga vrasja, në sallën e gjykimit, gjatë ushtrimit të detyrës, e kolegut tonë, gjyqtarit Astrit Kalaja. Humbja e tij na kërkon të shohim me seriozitet sigurinë në çdo gjykatë: <i>çfarë masash janë marrë, ku ka mangësi dhe kush mban përgjegjësi për t’i kapërcyer ato?</i> Kur siguria e një gjyqtari cenohet për shkak të detyrës, vihet nën presion vetë ushtrimi i drejtësisë.</p><p>Prandaj siguria, ashtu si burimet njerëzore, infrastruktura, teknologjia dhe financimi, nuk përbën një kërkesë për komoditetin e gjyqtarëve. Ajo është pjesë e kushteve, që shteti duhet të garantojë që drejtësia të funksionojë.</p><p>Për këto arsye, vazhdimisht është kërkuar më shumë nga Këshilli, jo sepse ai mund t’i zgjidhë i vetëm të gjitha këto probleme, por sepse një organ qeverisës duhet t’i identifikojë në kohë, t’i bëjë të qarta, të kërkojë burimet e nevojshme, të propozojë zgjidhje dhe të bashkëpunojë me institucionet e tjera <strong>derisa të arrihen rezultate konkrete.</strong></p><p>Detyra e Këshillit nuk është vetëm të trajtojë nevojat e sotme të gjykatave. Ajo kërkon edhe aftësinë për t’i dalluar problemet përpara se ato të shndërrohen në kriza.</p><p>Mandati i anëtarëve të Këshillit që zëvendësohen po përfundon.&nbsp;Kjo na jep mundësinë të vlerësojmë me drejtësi punën që ata kanë bërë dhe të nxjerrim mësime nga ajo që nuk ka funksionuar siç duhej. <strong>Ata kanë dhënë kontributin e tyre në ushtrimin e përgjegjësive të Këshillit gjatë një periudhe me vështirësi të mëdha për sistemin.&nbsp;</strong>Megjithatë, gjykatat kanë pasur nevojë për vendimmarrje më të shpejtë, për më shumë vëmendje ndaj vështirësive të tyre dhe për një Këshill që t’u paraprijë problemeve.&nbsp;Prandaj zgjedhja e sotme nuk është thjesht plotësimi i tri vendeve. Ajo lidhet me mënyrën se si Këshilli do ta ushtrojë përgjegjësinë e tij në vitet që vijnë.</p><p>Në këtë zgjedhje, përgjegjësia na takon drejtpërdrejt edhe ne. Në vlerësimin tonë kanë rëndësi aftësia profesionale dhe integriteti, si edhe aftësia për të punuar në një organ kolegjial, për të dëgjuar mendime të ndryshme, për të argumentuar dhe për të marrë vendime të përbashkëta.&nbsp;</p><p>Që vendimet e Këshillit t’u përgjigjen gjykatave, anëtarët e tij duhet ta njohin nga afër punën e tyre, të dëgjojnë gjyqtarët, drejtuesit dhe administratën, si dhe të kuptojnë kushtet në të cilat ushtrohet çdo ditë funksioni gjyqësor. Pas statistikave janë njerëzit që punojnë në gjykata. Çdo vend vakant shton ngarkesën e gjyqtarëve të tjerë. Çdo vonesë në emërim, ngritje në detyrë apo vlerësim profesional prek edhe funksionimin e gjykatës. Këshilli duhet t’i njohë këto pasoja dhe të veprojë në kohë. <strong>Këtë aftësi duhet të kemi parasysh kur të votojmë. Zgjedhja i takon bindjes së lirë të gjithsecilit, ndërsa përgjegjësia për Këshillin që formojmë është e përbashkët.</strong></p><p>&nbsp;</p><p><strong>Të nderuar kolegë,</strong></p><p>Kjo mbledhje zhvillohet në një moment kur debati publik ka sjellë përsëri në vëmendje marrëdhëniet ndërmjet pushteteve, autoritetin e vendimeve të Gjykatës Kushtetuese dhe garancitë që lidhen me statusin e gjyqtarit. Ky nuk është objekti i mbledhjes së sotme, por nga çdo mosmarrëveshje institucionale duhet të dimë të nxjerrim mësime.</p><p>Pavarësia e institucioneve nuk provohet kur të gjithë janë dakord. Ajo provohet pikërisht kur lind mosmarrëveshja. Atëherë shihet nëse institucionet dinë të argumentojnë, të mbrojnë kompetencat e tyre, të përdorin mjetet kushtetuese dhe të dialogojnë pa hequr dorë nga parimet.</p><p>Kam mbrojtur dhe vazhdoj të mbroj dialogun institucional. Ndarja e pushteteve nuk nënkupton mungesën e dialogut ndërmjet tyre. Dialogu institucional, megjithatë, kërkon më shumë se uljen e palëve në një tryezë. Ai duhet të ketë një objekt të qartë, të respektojë kompetencat e secilit dhe të mbështetet në një bazë juridike të përbashkët. Për mosmarrëveshjen rreth ligjit për pagat e magjistratëve, është Gjykata Kushtetuese që do të vendos përfundimisht. Kushtetuta nuk negociohet. As gjykimi kushtetues nuk mund të zëvendësohet nga një tryezë dialogu. Vendimi që do të merret duhet të respektohet dhe të zbatohet.</p><p>Kjo është arsyeja pse duhet të jemi të qartë edhe për objektin e tryezës së konsultimit, në të cilën Kryeministri ka ftuar të gjithë drejtuesit e institucioneve të drejtësisë, të gjykatave dhe të prokurorive të Republikës. Objekti i saj është politika e pagave në sistemin e drejtësisë dhe mekanizmi për përcaktimin e tyre.</p><p><strong>Pikërisht për këtë çështje qëndrimi ynë duhet të jetë i qartë. Për sa kohë ligji dhe pretendimet kushtetuese të ngritura ndaj tij janë në shqyrtim përpara Gjykatës Kushtetuese, themeli juridik i kësaj mosmarrëveshjeje nuk mund të negociohet në një tryezë tjetër. Nuk mund të negociohet kuptimi i Kushtetutës, fuqia detyruese e vendimeve të Gjykatës Kushtetuese dhe as të paraprihet ajo që mund të vendoset prej saj.&nbsp;</strong></p><p>Kjo nuk do të thotë se duhet të mbyllim derën e dialogut. Ato që mendojmë, ato që diskutojmë ndërmjet nesh dhe ato që kemi bërë publike duhet të kemi gatishmërinë t’i themi drejtpërdrejt në çdo tryezë. Prania në tryezë nuk do të thotë heqje dorë nga qëndrimet tona dhe as pranim i premisave të palës tjetër. <strong>Dialogu nuk është nënshtrim. Ai është mënyra institucionale për të mbrojtur qëndrimin me argumente, për të dëgjuar mendimin ndryshe dhe për të kërkuar hapësirën e bashkëpunimit që Kushtetuta lejon.&nbsp;</strong></p><p>Ne duhet të jemi po aq të qartë edhe për kufijtë e këtij dialogu. Ai nuk mund të nisë dhe të përfundojë te paga. Çështja e pagave është e rëndësishme, sepse prek drejtpërdrejt një nga garancitë e pavarësisë së gjyqësorit, por ajo nuk përmbledh problemet e drejtësisë shqiptare. Një dialog serioz ndërmjet pushteteve duhet të shkojë përtej mosmarrëveshjes së momentit dhe të përballet me çështjet që përcaktojnë në mënyrë reale aftësinë e sistemit për të dhënë drejtësi.</p><p>Sot vendit i duhet një<strong> “Tryezë për funksionimin dhe konsolidimin e sistemit të drejtësisë”,</strong> i duhet një proces institucional me vështrim afatgjatë, ku secili pushtet të marrë përgjegjësi për çështjet që i përkasin dhe ku bashkëpunimi të çojë në zgjidhje konkrete.&nbsp;</p><p>Prandaj, dialogu nuk duhet të mbetet vetëm te paga.&nbsp;<strong>Është koha t’u japim përgjigje çështjeve që përcaktojnë funksionimin e drejtësisë:</strong>&nbsp;<i>sa gjyqtarë dhe prokurorë i duhen Shqipërisë, si do të plotësohen vendet vakante, si do të ulet stoku i çështjeve dhe kohëzgjatja e proceseve?</i>&nbsp;Duhet të përcaktojmë çfarë administrate, teknologjie, infrastrukture dhe sigurie u duhen gjykatave dhe si do të financohen këto nevoja në mënyrë të qëndrueshme. Për këtë duhen një rend pune konkret, përgjegjësi të qarta dhe vendime të zbatueshme.</p><p>Asnjë institucion nuk mund t’u përgjigjet i vetëm këtyre nevojave. KLGJ-ja duhet t’i njohë vështirësitë e gjykatave, t’i paraqesë qartë dhe të propozojë zgjidhje. Institucionet e tjera duhet të përmbushin përgjegjësitë që u takojnë. Bashkëpunimi mes tyre është i domosdoshëm dhe duhet të zhvillohet duke respektuar pavarësinë e gjyqësorit.</p><p>Pushtetet janë të ndara, por shteti është një. Edhe qytetari është i njëjti. Për të, ndarja e kompetencave dhe e përgjegjësive buxhetore ndërmjet institucioneve nuk mund të shërbejë si shpjegim për vonesën e drejtësisë. Ai pret që çështja e tij të gjykohet në kohë, me cilësi dhe me dinjitet. Për këtë duhet të shërbejë dialogu, që çdo pushtet të përmbushë detyrën e vet dhe që pushtetet, së bashku, të krijojnë kushtet që drejtësia të funksionojë.</p><p><strong>Të nderuar kolegë,</strong></p><p>Përgjegjësia ndaj qytetarit kërkon që edhe ne ta qeverisim mirë gjyqësorin. Sot kemi mundësinë të ndikojmë drejtpërdrejt në këtë drejtim, duke zgjedhur tre anëtarët gjyqtarë të Këshillit të Lartë Gjyqësor.&nbsp;</p><p>Pas pak do të dëgjojmë kandidatët. Secili meriton të vlerësohet për përvojën, gjykimin dhe idetë që sjell. Vota e secilit është personale dhe e fshehtë. Le ta japim lirisht, duke vlerësuar cilët kandidatë mund t’i njohin nga afër nevojat e gjykatave dhe të marrin vendime që u përgjigjen atyre.</p><p>Vendimet e Këshillit do të ndikojnë në punën e gjykatave dhe, përmes saj, në mundësinë e qytetarëve për të marrë drejtësi. Për këtë arsye, zgjedhja e sotme nuk përfundon me shpalljen e rezultatit. Të zgjedhurit duhet ta përligjin besimin e marrë me punën e tyre. Ne duhet ta ndjekim atë punë me të njëjtën ndershmëri me të cilën bëjmë sot zgjedhjen. T’i mbështesim vendimet e mira dhe të kërkojmë përmirësim aty ku Këshilli nuk u përgjigjet nevojave të gjykatave.&nbsp;</p><p>Sot vota është e secilit prej nesh. Përgjegjësia për mënyrën si do të qeveriset gjyqësori është e të gjithëve.</p><p>Ju faleminderit!</p>","text_en":"<p><strong>Welcome Address</strong></p><p><strong>General Assembly of Judges of the Republic</strong></p><p><strong>25 September 2026</strong></p><p>&nbsp;</p><p><strong>Honourable judges of the Republic,</strong></p><p><strong>Distinguished heads and representatives of constitutional institutions,</strong></p><p><strong>Ladies and gentlemen,</strong></p><p>&nbsp;</p><p>Today’s assembly is of particular importance for the governance of the judiciary. Electing three new members of the High Judicial Council is one of our principal responsibilities in governing ourselves. Today, we are doing more than filling three seats on the Council. Through our votes, we will influence how the judiciary is governed in the years ahead.</p><p>As part of the Council’s renewal, the three members we elect will be joined by two non-judge members elected by Parliament. Five of the Council’s eleven members will be replaced by new members. That is almost half of its membership. This gives today’s process particular institutional weight and places on us a responsibility that extends beyond the act of voting itself.</p><p>Before we vote, I believe it is useful to reflect on a few questions: <i>What have we expected of the Council? What have we received from it? What has not worked well? And, above all, what kind of Council do we need for the future?</i></p><p>Over the years, I have spoken often about the High Judicial Council. I have supported it when I believed support was called for. I have acknowledged what it has done well, but I have also been critical when I believed that its pace, decisions or results did not meet the needs of the system.</p><p>I believe institutions are not protected by remaining silent about their weaknesses. They are protected when they have both the courage to recognise those weaknesses and the ability to correct them.</p><p>The High Judicial Council has carried out its mandate during an exceptionally difficult period. The consequences of the vetting process, the shortage of judges and the reorganisation of the judicial map have made appointments, promotions, transfers and evaluations more difficult. At certain times, courts have had to manage their caseloads with far fewer resources than they needed. The Council’s efforts to keep the system functioning under these conditions deserve recognition. It is equally necessary to consider where its decisions need to be made more swiftly and respond more closely to the needs of the courts.</p><p>Eight years after the bodies governing the justice system were established, we now have enough experience to measure success not only by the creation of institutions, but by how they function and the results they produce.</p><p>The Constitution has entrusted the High Judicial Council with responsibility for the proper functioning and governance of the judiciary. The question, therefore, is not how many acts have been adopted or how many procedures have been opened. The more important question is: what has actually changed in the courts’ ability to deliver timely, high-quality justice to the public? That is where a true assessment begins.</p><p>A court cannot function on laws and regulations alone. It needs enough judges, professional administrative staff, court leaders and chancellors appointed in good time, advisers and support staff, modern technology, security, suitable premises and financial resources that match its responsibilities.</p><p>A judge finds it difficult to develop a career normally when ethical and professional evaluations are delayed beyond any reasonable time. The administration of a court is weakened when leadership positions remain vacant for years. The speed and quality of adjudication suffer when heavy caseloads must be handled by fewer judges and staff than the system needs to function normally.</p><p>Justice in the twenty-first century requires modern technology. The dignity of justice requires buildings, courtrooms and working conditions suited to the function carried out within them. Above all, judicial independence requires judges to perform their duties free from fear and threats.</p><p>In a few days, on 6 October, it will be one year since our colleague, Judge Astrit Kalaja, was killed in a courtroom while performing his duties. His loss requires us to examine security in every court with the utmost seriousness: <i>what measures have been taken, where are the shortcomings, and who is responsible for addressing them?</i> When a judge’s safety is threatened because of their duties, the administration of justice itself comes under pressure.</p><p>Security, like human resources, infrastructure, technology and funding, is therefore not a matter of comfort for judges. It is part of the conditions the state must guarantee for justice to function.</p><p>For these reasons, more has consistently been expected of the Council. This is not because it can solve all these problems on its own, but because a governing body must identify them in good time, make them clear, seek the necessary resources, propose solutions and work with other institutions until concrete results are achieved.</p><p>The Council’s task is not only to address the courts’ present needs. It also requires the ability to recognise problems before they become crises.</p><p>The terms of the Council members who are being replaced are coming to an end. This gives us an opportunity to assess their work fairly and draw lessons from what has not worked as it should. They have contributed to the Council’s work during a period of great difficulty for the system. Nevertheless, the courts have needed swifter decisions, greater attention to the difficulties they face, and a Council that anticipates problems. Today’s election is therefore more than the filling of three seats. It concerns how the Council will discharge its responsibilities in the years ahead.</p><p>In this election, responsibility also rests directly with us. We ourselves will elect the three judge members. Through this choice, we exercise the judiciary’s right to govern itself and take responsibility for how the Council will function.</p><p>The colleagues who have decided to stand for election deserve respect for their willingness to assume this responsibility. In assessing them, professional ability and integrity matter, as does the ability to work within a collegial body: to listen to differing views, to reason through issues and to reach decisions together.</p><p>For the Council’s decisions to meet the needs of the courts, its members must know their work at first hand, listen to judges, court leaders and administrative staff, and understand the conditions in which judicial duties are performed every day. Behind the statistics are the people who work in the courts. Every vacancy increases the workload of other judges. Every delay in an appointment, promotion or professional evaluation also affects the functioning of a court. The Council must understand these consequences and act in good time. We should bear this ability in mind when we vote. Each person is free to vote according to their own conviction, while responsibility for the Council we form is shared.</p><p><strong>Dear colleagues,</strong></p><p>This assembly takes place at a time when public debate has once again brought attention to the relationship between the branches of government, the authority of Constitutional Court decisions and the guarantees attached to the status of judges. These matters are not the subject of today’s assembly, but we should be able to learn from every institutional disagreement.</p><p>The independence of institutions is not tested when everyone agrees. It is tested precisely when disagreement arises. That is when we see whether institutions can put forward reasoned arguments, defend their powers, use constitutional means and engage in dialogue without abandoning their principles.</p><p>I have defended institutional dialogue and continue to do so. The separation of powers does not mean that the branches of government cannot engage in dialogue. Institutional dialogue, however, requires more than bringing the parties to a table. It must have a clear purpose, respect the powers of each institution and rest on a shared legal foundation. The Constitutional Court will make the final adjudication about the dispute concerning the law on magistrates’ salaries. The Constitution is not open to negotiation, nor can constitutional adjudication be replaced by a dialogue table. The decision that is made must be respected and implemented.</p><p>That is why we must also be clear about the purpose of the consultation meeting to which the Prime Minister has invited all the heads of the Republic’s justice institutions, courts and prosecution offices. Its purpose is salary policy in the justice system and the mechanism for determining salaries.</p><p>Our position on precisely this point must be clear. While the law and the constitutional claims raised against it are under review before the Constitutional Court, the legal foundation of this dispute cannot be negotiated at another table. The meaning of the Constitution and the binding force of Constitutional Court decisions cannot be negotiated, nor can anyone pre-empt what the Court may decide.</p><p>This does not mean that we should close the door to dialogue. We should be prepared to state directly at any meeting what we think, what we discuss among ourselves and what we have said publicly. Being present at the table does not mean abandoning our positions or accepting the other party’s premises. Dialogue is not submission. It is an institutional way to defend a position with arguments, listen to a different view and seek the scope for cooperation that the Constitution permits.</p><p>We must be equally clear about the limits of this dialogue. It cannot begin and end with salaries. The issue of salaries is important because it directly concerns one of the guarantees of judicial independence, but it does not encompass all the problems facing Albanian justice. Serious dialogue between the branches of government must go beyond the dispute of the moment and confront the issues that truly determine the system’s ability to deliver justice.</p><p>Today, the country needs a “Forum on the Functioning and Consolidation of the Justice System”. It needs an institutional process with a long-term view, in which each branch takes responsibility for the matters within its remit and cooperation leads to concrete solutions.</p><p>Dialogue, therefore, should not be confined to salaries. It is time to answer the questions that determine how justice functions: how many judges and prosecutors does Albania need, how will vacancies be filled, and how will the backlog of cases and the length of proceedings be reduced? We must determine what administrative staff, technology, infrastructure and security the courts need, and how these needs will be funded sustainably. This requires a concrete agenda, clear responsibilities and decisions that can be implemented.</p><p>No institution can meet these needs on its own. The High Judicial Council must understand the courts’ difficulties, set them out clearly and propose solutions. Other institutions must fulfil their own responsibilities. Cooperation among them is essential and must proceed with respect for judicial independence.</p><p>The branches of government are separate, but the state is one. The person seeking justice remains the same. For the citizen the division of powers and budgetary responsibilities among institutions cannot serve as an explanation for delayed justice. He expects his case to be heard in a timely manner, with quality and dignity. That is what dialogue should serve: enabling each branch to fulfil its duty and, together, creating the conditions for justice to function.</p><p><strong>Dear colleagues,</strong></p><p>Our responsibility to the public requires us, too, to govern the judiciary well. Today, we have an opportunity to influence this directly by electing the three judge members of the High Judicial Council.</p><p>Shortly, we will hear from the candidates. Each deserves to be assessed on the experience, judgment and ideas they bring. Each vote is personal and secret. Let us cast our votes freely, considering which candidates can understand the courts’ needs at first hand and make decisions that respond to them.</p><p>The Council’s decisions will affect the work of the courts and, through that work, the public’s ability to obtain justice. For this reason, today’s choice does not end when the result is announced. Those elected must justify the trust placed in them through their work. We must follow that work with the same honesty with which we make our choice today. We should support good decisions and seek improvement where the Council does not meet the courts’ needs.</p><p>Today, each of us has a vote.
